Robert Duncan is a director/ principal of Duncan Solicitors Pty Ltd. Robert entered the legal profession later in life after a successful business career as the principal of his own enterprises in import/export, residential finance and real estate. His background in import/export which required him to negotiate contracts and business arrangements in Hong Kong, Thailand, S. Korea, Italy, Germany, Nederland’s, England, USA and Mexico, has given him first-hand knowledge and a wealth of experience in Contract Law.
Robert has a certificate IV in financial services and has held a full real estate licence. He employed 8 loan writers in a Mortgage Broker Business which provided experience in property Law and Conveyancing from the purchasers’ perspective.
Robert has a thorough understanding of franchise law. His tenacity is a character trait. Against the odds he undertook an appeal in the Supreme Court of Appeal NSW and was successful in overturning the primary judge’s decision on liability. While the appeal in this landmark case was lost, he set an important precedent by providing the court with a framework with which to define the meaning and scope of a “franchise fee”.
